1. Acceptance of these Terms

These Terms of Use (“Terms”) are an agreement between you and Roadster Sale (“Roadster Sale,” “we,” “us” or “our”) governing your use of roadster-sale.us and related communications (the “Site”). By accessing or using the Site, you agree to these Terms and to our Privacy Policy and Cookie Policy. If you do not agree, do not use the Site.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Site. The Site and our Services are intended for residents of the United States.

3. About us and trademarks

Roadster Sale is an independent dealer of pre-owned and classic roadsters. We are not affiliated with, sponsored by or endorsed by any vehicle manufacturer. Manufacturer names, model names and logos that may appear in vehicle descriptions or documents belong to their respective owners and are used only to identify the vehicles we offer.

4. Vehicle listings, illustrations and pricing

• Illustrations. Vehicle graphics on the Site are stylized artwork for design purposes and do not show the actual vehicle. Photos and videos of a specific vehicle are provided with its listing details or on request.
• Accuracy. We work to describe each vehicle accurately, but listings can contain errors in specifications, equipment, mileage, history or price. Please confirm any detail that matters to you with us before you buy. We may correct errors at any time, including after you've placed a deposit — in that case you can cancel and receive a full refund of your deposit.
• Pricing. Listed prices are in U.S. dollars and exclude sales or use tax, title, registration and license fees, any documentation fee permitted by state law, and delivery charges, all of which are itemized before you sign.
• Availability. All vehicles are subject to prior sale. A listing does not reserve a vehicle; only a confirmed deposit does.
• No offer. Listings and other content on the Site are invitations to discuss a purchase, not offers to sell. A sale is binding only when both you and Roadster Sale sign a written purchase agreement.

5. Inspections, history reports and vehicle condition

Our inspection reports describe a vehicle's condition as observed on the inspection date by our technicians. They are not a warranty and cannot reveal every defect, particularly in older vehicles. Vehicle history reports come from third-party providers and may not include every event, such as accidents that were never reported.

We encourage you to review all reports, ask questions and, if you wish, arrange an independent pre-purchase inspection at your own expense.

Used vehicles are sold with the warranty terms stated on the FTC Buyers Guide displayed for that vehicle — which may be “As Is – No Dealer Warranty” — and in your purchase agreement. The information on the Buyers Guide is part of your contract of sale and overrides any contrary provisions in the contract. Nothing in these Terms limits any implied warranty or consumer right that cannot be waived under applicable law.

6. Deposits, viewings, test drives and returns

• Deposits reserve a vehicle for the period we confirm in writing and are fully refundable until you sign the purchase agreement.
• Viewings and test drives are by appointment. To test drive, you must present a valid U.S. driver's license, may be asked for proof of insurance, and must follow all traffic laws and our staff's instructions. We may decline or end a test drive for safety reasons.
• Returns. Our 7-day / 300-mile return program, and its conditions, are set out in the purchase agreement. If the agreement and the Site differ, the agreement controls.

7. Financing estimates

The payment calculator and any payment examples on the Site are for illustration only. They are not an offer of credit, a pre-approval or a guarantee of any rate or term. Actual rates and payments depend on your credit history, the vehicle, the down payment, the term and lender approval. Credit decisions are made solely by lenders. If you ask us to, we may submit your application to one or more lending partners; the lender's terms and privacy notice will apply.

8. Selling or trading in a vehicle

Offers we make for your vehicle are based on the information and photos you provide and are subject to a physical inspection and verification of title, liens, odometer reading and history. We may revise or withdraw an offer if the vehicle's condition or history differs from what was described. Unless we say otherwise in writing, offers are valid for 7 days. By submitting a vehicle, you represent that you are its owner or are authorized by its owner, and that the information you provide is accurate.

9. Delivery

Delivery dates are estimates. Transport is arranged with third-party carriers, and delays caused by weather, carrier scheduling or events beyond our control can occur. Risk of loss, delivery charges and inspection on arrival are governed by your purchase agreement.

10. Acceptable use

You agree not to:

• use the Site in violation of any law or to submit false, misleading or fraudulent information;
• impersonate any person or misrepresent your affiliation with anyone;
• scrape, copy or harvest listings or data from the Site using automated means without our written permission;
• interfere with the Site's security or operation, including by introducing malware, probing for vulnerabilities or overloading our systems;
• use the Site to send spam or unsolicited communications; or
• reproduce, sell or exploit any part of the Site for commercial purposes without our written permission.

11. Your submissions

When you send us messages, photos, videos or documents, you keep ownership of them. You grant us a non-exclusive, royalty-free license to use, store and reproduce them as needed to respond to you, evaluate your vehicle and provide our Services. If you send us feedback or suggestions about the Site, we may use them without obligation to you. Do not send content that you don't have the right to share, or sensitive information such as full bank account or Social Security numbers.

12. Intellectual property

The Site and its content — including text, design, illustrations, graphics, logos and code — are owned by or licensed to Roadster Sale and are protected by copyright, trademark and other laws. We grant you a limited, revocable, non-transferable license to view the Site for your personal, non-commercial use. All other rights are reserved.

If you believe content on the Site infringes your copyright, email [email protected] with a description of the work, where it appears on the Site, your contact details, and a statement made in good faith and under penalty of perjury that you are the owner or authorized to act for the owner.

13. Third-party sites and services

The Site may link to third-party websites and services, such as lenders, vehicle history providers and transport companies. We do not control and are not responsible for their content, policies or practices. Your use of them is at your own risk and subject to their terms.

14. Electronic communications

By using the Site or emailing us, you consent to receive communications from us electronically, and you agree that agreements, notices and disclosures we provide electronically satisfy any legal requirement that they be in writing. Before you sign a purchase agreement electronically, we will provide any additional disclosures required by the federal E-SIGN Act.

15. Disclaimers

EXCEPT AS EXPRESSLY STATED IN A WRITTEN PURCHASE AGREEMENT OR BUYERS GUIDE, THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF HARMFUL COMPONENTS. This section applies to the Site only and does not limit any warranty provided for a vehicle in your purchase agreement or Buyers Guide.

16. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ROADSTER SALE AND ITS OWNERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). Claims relating to a vehicle purchase or sale are governed by the purchase agreement. Some states do not allow certain limitations of liability, so some of these limitations may not apply to you.

17. Indemnification

You agree to indemnify and hold harmless Roadster Sale from any claims, losses and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of the Site, to the extent permitted by law.

18. Governing law and disputes

These Terms are governed by the laws of the state in which Roadster Sale has its principal place of business and by applicable U.S. federal law, without regard to conflict-of-laws rules, except where the law of your state of residence requires otherwise.

Before filing a claim, you agree to try to resolve the dispute informally by emailing [email protected] with a description of the issue. We'll try to resolve it within 30 days. If we can't, either party may bring a claim in a court of competent jurisdiction, or in small claims court if the claim qualifies. Disputes about a vehicle transaction are governed by the dispute resolution terms in the purchase agreement.

19. Changes to the Site and these Terms

We may change or discontinue any part of the Site at any time. We may update these Terms by posting a new version and changing the “Last updated” date. Changes apply from that date to your future use of the Site. If you continue to use the Site after the update, you accept the revised Terms.

20. General

If any provision of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a business transfer. These Terms, together with the policies they reference, are the entire agreement between you and us about the Site. Section headings are for convenience only.
